A federal judge has ruled that the Bureau of Prisons (BOP) must provide laser hair removal, facial feminization surgery consultations, and voice therapy for a convicted pedophile who now identifies as transgender.

The inmate, known as Brian Buckingham, 47, was sentenced to over 21 years in prison for sexually abusing his 10-year-old son and producing child pornography. Shortly before sentencing, Buckingham declared a new identity as “Nani Love” and began identifying as female, according to Reduxx.

According to court filings, Buckingham claimed that halting previously provided “gender-affirming” treatments—including hormone therapy—had worsened depression and suicidal thoughts. The defense argued that the procedures were “medically necessary” to treat gender dysphoria and that denying them violated Buckingham’s Eighth Amendment rights.

In September, Magistrate Judge David Christel determined that Buckingham was “likely to succeed” on the claim that the BOP’s denial of treatment amounted to cruel and unusual punishment. Christel cited evidence that the BOP had acknowledged Buckingham’s requests for gender-related procedures but then “discontinued them without reason.”

Christel’s recommendation was later adopted by US District Judge Ricardo Martinez, who ordered the Bureau of Prisons to provide consultations for the cosmetic procedures within 30 days.

The BOP objected, asking the court to dismiss or delay the case pending the outcome of Kingdom v. Trump, a separate class-action lawsuit filed by other transgender inmates challenging Trump admin restrictions on gender-affirming care in federal facilities. Buckingham’s lawyers responded that their client faced “irreparable harm” and needed urgent intervention.

Buckingham, who was once involved in suicide prevention efforts for the Makah Indian Nation, admitted to producing explicit material featuring his son after a lengthy investigation that began on Discord in 2020. The videos were discovered after moderators flagged child abuse imagery linked to his account.

Despite his conviction for child sexual assault, Buckingham’s legal team insists the inmate should receive full access to transition-related treatments while serving time at FCI Butner in North Carolina.

The court has not yet ruled on the BOP’s objection. If upheld, the injunction would force federal prisons to resume providing gender-affirming services, potentially setting a new precedent for inmates under Trump-era restrictions.
